These Terms and Conditions constitute a comprehensive legal agreement that governs your relationship with Elite Scrum Academy, including your use of our website, training programs, educational materials, and all related services.
This agreement is entered into on the date you first access our services or create an account with us. Your continued use of our services constitutes ongoing acceptance of these terms, including any modifications we may make from time to time.
If you do not agree with any part of these terms and conditions, you must immediately discontinue use of our services. These terms supersede any previous agreements or understandings between you and Elite Scrum Academy.

Age Restrictions and Legal Capacity
You must be at least 18 years of age to enter into this agreement. If you are under 18, you may only use our services with parental or guardian consent and supervision.
Minors using our services must have a parent or legal guardian review and accept these terms on their behalf.

Maintain respectful and professional interactions with instructors and fellow participants at all times.
Punctuality and Commitment
Attend scheduled sessions punctually and complete assigned coursework within specified timeframes.
Academic Integrity
Complete all assessments honestly without unauthorized assistance or plagiarism.
Indemnification Obligations
You agree to indemnify and hold harmless Elite Scrum Academy from any claims, damages, or expenses arising from:
- Your violation of these terms and conditions
- Your infringement of third-party intellectual property rights
- Any content you submit or share through our platform
- Your negligent or wrongful conduct
Third-Party Interactions and Relationships
Employer Relations
Maintain professional relationships with current and prospective employers facilitated through our platform.
Professional Network

Comply with the standards and requirements of external certification organizations when applicable.

Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied.
No Guarantee of Outcomes
We do not guarantee specific career outcomes, salary increases, or employment opportunities.
Technical Performance
We disclaim warranties regarding uninterrupted service, error-free operation, or compatibility with all devices.
Third-Party Content
We are not responsible for the accuracy or reliability of third-party content or external links.
Limitation of Liability
Maximum Liability Cap
Our total liability to you for any claims arising from these terms or your use of our services shall not exceed the amount you paid to us in the 12 months preceding the claim.
Consequential Damages Exclusion
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption.
Time Limitation for Claims
Any claims against Elite Scrum Academy must be brought within one year of the date the cause of action arose, after which time such claims are permanently barred.
Force Majeure Provisions
Elite Scrum Academy shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:
- Natural disasters or extreme weather events
- Pandemics or public health emergencies
- Government actions or regulatory changes
- Internet service provider outages
- Third-party service provider failures
- Cybersecurity incidents or attacks
Legal Governance and Dispute Resolution
Governing Law and Jurisdiction
Applicable Law
- These terms are governed by the laws of Sri Lanka
- Applicable consumer protection regulations
- Relevant data protection and privacy laws
Legal Jurisdiction
- Courts of Colombo, Sri Lanka have exclusive jurisdiction
- All legal proceedings must be conducted in Sri Lanka
- Proceedings conducted in English language
Dispute Resolution Procedures
Step 1: Direct Negotiation
Before pursuing formal legal action, parties must attempt to resolve disputes through good faith negotiations.
Timeline: 30 days from written notice of dispute
Process: Written communication followed by video or in-person meeting if needed
Step 2: Mediation
If direct negotiation fails, disputes shall be submitted to mediation through a qualified neutral mediator.
Location: Colombo, Sri Lanka or virtual mediation platform
Cost Sharing: Equally split between parties
Step 3: Legal Action
Only after unsuccessful mediation may parties pursue binding legal proceedings in appropriate courts.
Venue: District Court of Colombo or Commercial High Court as appropriate
Limitation: Claims must be filed within one year of dispute arising
Severability and Terms Modification
Severability Clause
If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary.
The remainder of these terms will remain in full force and effect and continue to be binding and enforceable.
Terms Modification Policy
We reserve the right to modify these terms at any time. Changes will be effective upon posting to our website.
Continued use of our services after changes constitutes acceptance of the modified terms.
Notice of Changes: Significant modifications will be communicated to active users via email at least 30 days before taking effect. You may terminate your account if you disagree with material changes.
